Texas House Bill 1560 was enacted earlier this year which transfers the regulation of Residential Service Companies (RSCs) from the Texas Real Estate Commission (TREC) to the Texas Department of Licensing and Regulation (TDLR).
H.B. 1560 requires TDLR to adopt new RSC administrative rules no later than June 1, 2022. The TDLR advises that existing rules relating to RSCs will remain in effect until that time and will be administered by the TDLR. In preparation for assuming responsibility of RSCs, TDLR has filed a Rules Transfer with the Texas Register, which enabled the new regulator to transfer the existing RSC rules found in Tex. Admin. Code, Chapter 539, from TREC to the TDLR. This also applies to any TREC fees, policies, procedures, decisions, and forms related to the regulation of RSCs.
